2. Your right as a person and data subject

As a data subject, you have the following rights regarding your personal data.  

  

You have:  

  • A right to information about, among other things, the categories of data processed, the purposes of processing, the storage period, and any recipients, in accordance with Art. 15 GDPR and § 34 BDSG.  
  • A right to rectification or erasure of inaccurate or incomplete data in accordance with Art. 16 and 17 GDPR and § 35 BDSG.  
  • Under the conditions of Art. 18 GDPR or § 35 para. 1 sentence 2 BDSG, a right to restriction of processing.  
  • A right to object to the processing in accordance with Art. 21 para. 1 GDPR, as far as the data processing was conducted on the basis of a legitimate interest.  
  • A right to withdraw consent given with immediate effect for the future in accordance with Art. 7 para. 3 GDPR.  
  • A right to data portability in a commonly used format pursuant to Art. 20 GDPR.  
  • In accordance with Art. 22 GDPR, you have the right not to be subject to a decision based solely on automated processing which produces legal effects concerning you or similarly significantly affects you. This also includes profiling within the meaning of Art. 4 No. 4 GDPR.  
  • You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us in accordance with Art. 77 GDPR, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.  

  

3. Procedure for the assertion of a person and data subject rights  

If you wish to assert your rights under the GDPR and the BDSG, the data you provide will be processed in order to fulfil your claim. Subsequently, the data transmitted by you and the data transmitted to you in return will be stored for documentation purposes until the expiry of a limitation period (3 years). The legal basis for the storage of the data is Art. 6 para. 1 sentence 1 letter f) GDPR (legitimate interest in data processing). The legitimate interest arises from my obligation to comply with your request and the need to be able to exonerate myself in possible fine proceedings by proving that I have duly complied with your request.  

 

4. Data transfer to third countries outside the EU  

All information that we receive from you or about you is generally processed on servers within the European Union. Your data will only be transferred to or processed in third countries without your express consent if this is provided for or permitted by law and an appropriate level of data protection is ensured in the third country.  

  

5. Forwarding of data, order processing  

Your personal data will not be passed on to third parties without authorization. A transfer is possible if the transfer is necessary to fulfil legal obligations or if a data transfer is necessary due to legal provisions or official or court orders. In particular, this may involve the provision of information for the purposes of criminal prosecution, security, or the enforcement of intellectual property rights.  

Under certain circumstances, your data may also be transferred to external service providers who process data on my behalf and in accordance with my instructions (processors) in order to simplify or relieve my own data processing. Each processor is bound by a contract in accordance with Art. 28 GDPR. This means in particular that the processor must offer sufficient guarantees that suitable technical and organizational measures are implemented by the processor in such a way that the processing is conducted in accordance with the requirements of the GDPR and the protection of your rights as a data subject is guaranteed. Despite commissioning processors, I remain the controller for the processing of your personal data within the meaning of data protection laws.  

 

B. Information on data processing on this website  

  

1. General contact  

The website provides a contact form for making contact. The data entered here, as far as it is personal data, is temporarily stored on the hosting provider's server and then forwarded via e-mail to the designated receiving mailbox. The forwarding takes place exclusively within the server, so that any risk to the confidentiality of the data is effectively excluded. The legal basis for the processing is Art. 6 para. 1 sentence 1 letter b) GDPR, as far as it concerns new contract-preparatory enquiries or questions about current contracts. Otherwise, the legal basis depends on the respective content of the enquiry. As far as we process the first name as voluntary information, this is done on the basis of the consent assumed at the time of entry in accordance with Art. 6 Para. 1 letter a) GDPR.  

  

2. E-mail contact  

At various points on the website, it is also possible to contact us via the e-mail address provided. In this case, the personal data transmitted, in particular the e-mail address itself, is stored. The data is used exclusively for processing the enquiry. The legal basis for the processing of the data is Art. 6 para. 1 sentence 1 letter f) GDPR. The legitimate interest in the processing of the data lies in the realization of the contact. The data will be deleted once the purpose no longer applies or the communication has ended. If a quotation process takes place in the course of communication, the processed data will be deleted after expiry of the retention periods provided for this purpose. 

 

3. Product enquiry  

You can send us enquiries for quotations, demonstrations, or appointments for meetings for all our products presented on the website. The data entered here, as far as it is personal data, is temporarily stored on the hosting provider's server and then forwarded via e-mail to the designated receiving mailbox. 4. Newsletter  

You can register for our newsletter on our website. After verification, the address you provide will be used to send you advertising messages on a permanent basis. If you have also left your name when registering, we will use this to personalize the address. The legal basis for processing is in any case your consent in accordance with Art. 6 para. 1 letter a) GDPR.  

  

5. Server log files  

Each time a website is accessed, and each time data is retrieved from a server, general information is automatically transmitted to the providing server. This data transmission is automatic and is a fundamental part of communication between devices on the Internet.  

The data transmitted by default includes the following information, among others: Your IP address, product and version information about the browser and operating system used (so-called user agent), the website from which your access took place (so-called referer), date and time of the request (so-called timestamp). In addition, the http status and the amount of data transferred as part of this request are recorded.  

This information is logged by the server, stored in a table, and saved there for a brief time (so-called server log files). By analysing these log files, we can detect and subsequently eliminate errors on the website, determine the utilisation of the website at certain times and, based on this, make adjustments or improvements and ensure the security of the server by being able to trace the IP address from which attacks on our server were carried out.  

Your IP address is only stored for the duration of your use of the website and is then immediately deleted or made partially unrecognisable by shortening it. The remaining data is stored for a limited period of time (usually 7 days).  

The legal basis for the use of the server log files is Art. 6 para. 1 sentence 1 letter f) GDPR (legitimate interest in data processing). The legitimate interest arises from the necessity for the operation and maintenance of our website, as we have explained above.  

  

6. Integrated services  

We also use services from other providers to operate our website, some of which process personal data.  

We have also implemented an administration tool for this purpose, which enables the necessary selection to be made when the page is first accessed. We provide information about the services used as follows:  

  

a. Use of Google Maps  

We use the function for embedding Google Maps from Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google") on our website.  

This function enables the visual display of geographical information and interactive maps. Google also collects, processes, and uses data from visitors to the pages when they access the pages in which Google Maps maps are integrated. Further information on the collection and use of data by Google can be found in Google's privacy policy at www.google.com/privacypolicy.html. There you also have the option of changing your settings in the data protection centre so that you can manage and protect your data processed by Google.  

Your data may also be transferred to the USA. The European Commission has issued an adequacy decision for data transfers to the USA.  

Processing only takes place on the basis of your consent in accordance with Art. 6 para. 1 letter a) GDPR.  

  

b. Use of Google Analytics  

We use the web analysis service Google Analytics from Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google") on our website. The purpose of data processing is to analyse the website and its visitors. For this purpose, Google will use the information obtained on behalf of the operator of this website.  

Information to analyse your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be combined with other Google data.  

Google Analytics uses cookies that enable your website usage statistics to be analysed. The information generated by the cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. IP anonymisation is activated on this website. As a result, your IP address will be anonymised by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.  

Your data transfer to the USA may be necessary. An adequacy decision by the European Commission is in place for data transfers to the USA. You can find more information on terms of use and data protection at

Processing only takes place on the basis of your authorisation in accordance with Art. 6 Para. 1 letter a) GDPR.  

  

c. Use of Google Fonts  

This website uses external fonts from Google. Google Fonts is a service of Google Inc ("Google"). These web fonts are integrated by a server call, usually a Google server in the USA. As a result, the server is informed which of our pages you have visited. The IP address of the browser of the end device of the visitor to this website is also stored by Google.

The processing takes place only on the basis of your consent in accordance with Art. 6 para. 1 letter a) GDPR.  

  

d. Use of Fontawesome  

This website uses external fonts from Fontawesome. Fontawesome is a service of Fonticons Inc, 307 S Main St Ste 202 Bentonville, AR, 72712-9214 United States. These web fonts are integrated by a server call, usually a server in the USA. As a result, the server is informed which of our pages you have visited. The IP address of the browser of the end device of the visitor to this website is also stored by Fonticons.

e. CDN from Cloudflare  

This website uses the Cloudflare content delivery network from Cloudflare, Inc. (101 Townsend St., San Francisco, CA 94107, USA) to make the website faster and more secure.

The processing is only conducted on the basis of our legitimate interest in the provision of stable website availability and compliance with security mechanisms. The legal basis is Art. 6 para. 1 letter f) GDPR.  

 

C. Information on data processing in relation to job applicants

 

If you apply to us through an online form, by email or by post, we will process the data you provide for the purpose of conducting the application process.  

The legal basis for this is Art. 6 para. 1 letter b) GDPR.  

We use the digital applicant management system of softgarden e-Recruiting GmbH, Tauentzienstr. 14, 10789 Berlin, Germany, to organise the selection process and to manage the documents from the application process. We have concluded an order processing contract with the provider in order to legitimise the data processing. If the application process is successfully completed, we will transfer the data you have submitted to our personal file, otherwise the data will be deleted 6 months after the end of the application process.
